李(li)先生(sheng)(sheng)逛(guang)街時(shi)無(wu)意在某中(zhong)介(jie)公(gong)司(si)地鋪看上(shang)一套房屋,看樓后(hou)很(hen)喜(xi)歡。中(zhong)介(jie)公(gong)司(si)表示業主(zhu)(zhu)放盤(pan)價是83萬(wan)元(yuan)(yuan)(yuan)實收(shou),李(li)先生(sheng)(sheng)表示80萬(wan)元(yuan)(yuan)(yuan)實收(shou)范圍內可接(jie)受。當晚李(li)先生(sheng)(sheng)即與中(zhong)介(jie)公(gong)司(si)簽訂了(le)《購(gou)房委(wei)托書》,并支(zhi)付(fu)(fu)了(le)1萬(wan)元(yuan)(yuan)(yuan)誠意金(jin)(jin),委(wei)托書約定(ding)(ding)如果業主(zhu)(zhu)同(tong)(tong)意80萬(wan)元(yuan)(yuan)(yuan)實收(shou)出售(shou)的(de)話則該誠意金(jin)(jin)作為定(ding)(ding)金(jin)(jin)直接(jie)由中(zhong)介(jie)公(gong)司(si)轉交(jiao)給業主(zhu)(zhu)。經(jing)中(zhong)介(jie)公(gong)司(si)爭取,業主(zhu)(zhu)同(tong)(tong)意以(yi)80萬(wan)元(yuan)(yuan)(yuan)實收(shou)價出售(shou)。于是中(zhong)介(jie)公(gong)司(si)約李(li)先生(sheng)(sheng)和業主(zhu)(zhu)見面,經(jing)協(xie)商一致后(hou),簽訂了(le)《三方房屋買(mai)賣合(he)同(tong)(tong)》。簽訂合(he)同(tong)(tong)后(hou),李(li)先生(sheng)(sheng)向業主(zhu)(zhu)支(zhi)付(fu)(fu)了(le)2萬(wan)元(yuan)(yuan)(yuan)定(ding)(ding)金(jin)(jin),并約定(ding)(ding)交(jiao)易(yi)遞件后(hou)向中(zhong)介(jie)公(gong)司(si)支(zhi)付(fu)(fu)2萬(wan)元(yuan)(yuan)(yuan)中(zhong)介(jie)費。
合同(tong)(tong)簽(qian)訂后第二天,李(li)(li)(li)(li)(li)先(xian)生(sheng)(sheng)帶(dai)家人(ren)再(zai)次到該房屋查看,全家人(ren)都覺得該房屋不(bu)(bu)符合自己需要。李(li)(li)(li)(li)(li)先(xian)生(sheng)(sheng)最終(zhong)決定不(bu)(bu)再(zai)購(gou)買(mai)該房屋,并到中(zhong)介(jie)公(gong)司要求(qiu)取(qu)消合同(tong)(tong),退回定金,但遭到中(zhong)介(jie)公(gong)司和(he)業主的(de)拒絕。李(li)(li)(li)(li)(li)先(xian)生(sheng)(sheng)認為自己倉促簽(qian)約因中(zhong)介(jie)公(gong)司不(bu)(bu)斷催促和(he)誘導造成的(de),責任(ren)應(ying)由(you)中(zhong)介(jie)公(gong)司負。半個月后,李(li)(li)(li)(li)(li)先(xian)生(sheng)(sheng)收(shou)到中(zhong)介(jie)公(gong)司的(de)《傭金追收(shou)函》,要求(qiu)李(li)(li)(li)(li)(li)先(xian)生(sheng)(sheng)支(zhi)付中(zhong)介(jie)費,李(li)(li)(li)(li)(li)先(xian)生(sheng)(sheng)不(bu)(bu)予理睬。中(zhong)介(jie)公(gong)司向法院(yuan)起訴李(li)(li)(li)(li)(li)先(xian)生(sheng)(sheng),法院(yuan)判(pan)決李(li)(li)(li)(li)(li)先(xian)生(sheng)(sheng)必須按合同(tong)(tong)約定支(zhi)付2萬(wan)元中(zhong)介(jie)費給中(zhong)介(jie)公(gong)司。

3.簽(qian)訂房屋買賣合(he)同時,要認(ren)真看(kan)清楚合(he)同內容,對于有異(yi)議的條(tiao)款,要與(yu)另一方當事人及中(zhong)介公司協(xie)商約定清楚后,再簽(qian)署合(he)同。
